Michael Jackson Killed by 'Mr X' - Part 1 (Article)

Death scene... syringe and Jacko's bedroomExclusive by James Desborough, US Editor
April 17, 2011

The fingerprints on the syringe that killed Michael Jackson are NOT his doctor's, we can reveal.

The bombshell new evidence means Dr Conrad Murray could walk free from his trial for involuntary manslaughter, which starts in just three weeks. And it supports his theory that a "Mr X" injected Jacko with a lethal dose of Propofol - before stealing more than a million dollars of his cash and fleeing.

Police will not be able to disprove Murray easily because in another twist they have LOST 24 hours of CCTV footage from Jacko's mansion that would have shown exactly who was inside when he died.

A source close to the case told the News of the World: "The mystery fingerprints are the biggest breakthrough for Murray so far. If it is handled right it would mean a jury cannot convict him. "Murray and Michael were the only ones supposedly at the house at the time. And all the syringes were vacuum-packed and sterile before use. "The fingerprints point to someone else being there and using the fatal syringe."

Murray's lawyer Ed Chernoff has now adopted the catchphrase: "If the print doesn't fit, you must acquit." It comes from OJ Simpson's lawyer Johnnie Cochran - who said, "If it doesn't fit, you must acquit" about a glove OJ was supposedly wearing when he allegedly murdered his wife. The jury found him not guilty.

The fingerprints on Jacko's syringe do not belong to any of his family or staff - and no one knows whose they are. They were found by Murray's legal team after they asked the Los Angeles Police Department for the coroners' "evidence box". Inside it were several syringes from Jacko's bedroom - including the one doctors said killed him - plus pills, drips, oxygen tanks and his clothes.

Murray's lawyers had them dusted for prints. Jackson, 50, overdosed on the powerful sedative Propofol in June 2009. Cardiologist Murray, who was paid £90,000 a month by the singer to be his personal doctor, is accused of negligently administering the drug.

He denies the charge, and faces up to four years in jail if found guilty. His lawyers will argue someone else gave Jacko the drug through a drip into his leg. They believe the mystery killer is the same person who swiped huge wads of cash lying around the mansion Jackson was renting in LA.

The "Mr X" defence ties into our exclusive story on how the Jackson family frantically called staff to try to find a massive sum of missing money in the hours after Jacko died. His children Paris, 12, and Prince, 13, sister LaToya and mum Katherine are all expected to testify at the trial that Jacko had bundles of $100 notes which vanished.

Our source said: "The missing CCTV tape also helps the theory. "Bodyguards say they handed over 24 hours-worth of footage from the day, which showed everyone who came and went. "Chernoff's been told it is no longer available. Somehow only a few minutes of the footage is left."

The twists could mean Murray, 56, may not even have to speak at the trial. He doesn't want to take the stand - and his team plan to submit a statement saying: "I didn't do it, and I don't know how it happened. I am deeply sorry for Michael's death. I never wanted him to die - he was my friend." His lawyers will also point out he would be mad to kill his employer, who paid him more than a million dollars a year.

But even if Murray is cleared of manslaughter, he will face a battle to clear his name. Last week court papers showed he was making flirty texts and calls to three women while Jacko lay dying. And we previously revealed he failed to administer proper CPR, refused to tell doctors about injecting Propofol and hid details of Jacko's pill use.

Jury selection starts this week and the prosecution's opening statements begin on May 9. Yesterday the LA District Attorney's office and Murray's spokesman refused to comment. But a Jackson family spokesman said: "They are concerned about all the matters around the death. They are unsure Conrad Murray will ever go to prison.

So let's dissect this article by News of the World (NOTW):

The syringe that was reported as being tested for fingerprints is the one that was called "broken" (it isn't actually broken, the plunger has just been pulled out of it.)

Dr. Conrad Murray Prelim: Day 4 Part II
January 7, 2011
Fleak notes “I did describe it as a broken’ syringe because the two pieces are separated from each other. I should have ...they’re not broken.”

Syringe on the table, needle on the floor. DDA asks Fleak if they may have been together they may not have been. Fleak answers correct.

Murray defense wants broken syringe’s first generation fingerprint

A new development in the Conrad Murray trial involving the death of Michael Jackson. The defense wants a first generation fingerprint of a broken syringe found in Michael’s bedroom. Sources say the defense thinks it could prove that Michael killed himself.

Murray’s lawyers were in court this morning. Among other things, they lasered in on a broken syringe that had rolled under Michael’s deathbed. The defense wants a first generation fingerprint to determine who was handling it.

Murray insists he did not break the syringe. The defense believes Michael caused his own death by giving himself a massive overdose of Propofol while Murray was out of the room. According to defense sources there were only two people in the room, and since Murray did not break the syringe, Michael must have handled it. The defense is asking that the FBI deliver the first generation fingerprint.

Mister X (Marvel Comics)
Mister X is a fictional character, a supervillain of the Marvel Universe introduced in Wolverine #159 (February, 2001).

Born into wealth, the man known as Mister X became fascinated with death as a child when he saw a woman hit by a car. The experience triggered his latent telepathy, forming a bond with the dying woman. He subsequently spent years attempting to recapture the thrill through other pursuits but finally sought out death again when he placed his pet dog into an oven. He slew his appalled parents shortly thereafter, beginning a life dedicated to the killing arts.

In an effort to become the greatest killing machine in history, X traveled the globe to train with various combat teachers, slaying each of them after surpassing their skills and scarring himself in a ritual fashion for each life he took. Destroying all records of his life, X then vanished from public view to embark upon his next goal of slaying fighters who professed to be the best. Eventually, he learned of the mutant adventurer Wolverine and sent his operatives to test Wolverine's battle prowess. Subsequently defeating Wolverine himself, X sought his signature in order to achieve the title of "The Best There Is," then invited Wolverine to join him in a new muter avant-garde. Enraged, Wolverine broke free and engaged X in a savage battle, loosing control in a berserker rage. The fight was interrupted by X's super-strong bodyguard Blok who, much to X's annoyance, knocked Wolverine unconscious. feeling that the fight ended unfairly, X released the unconscious Wolverine with a note promising a rematch. Soon after X secretly aided Wolverine against the clandestine Weapon X Program, not wanting them to interfere.

X's rematch with Wolverine came weeks later when both entered the annual Bloodsport Tournament on the island nation of Madripoor of which X was the reigning champion. Both fought their way to the championship bout with X killing Headhunter and attempting to kill Taskmaster before being stopped by the referee whom he killed in his stead. During the championship bout, Wolverine (who was fighting under the alias "Patch" at the time) realized that X was a telepath who used his abilities to anticipate opponents moves. After Wolverine succumbed to another berserker rage, X began loosing the fight, yet managed to win the Tournament in the process because of the rules of the fight. Wolverine was just about to kill X but he was again saved by Blok and escaped.

There is something weird about this because Elissa Fleak testified to this...

Dr. Conrad Murray Prelim: Day 4 Part II
January 7, 2011

Q: This IV bag had some tubing coming down from it.

Fleak: Yes. And in the tubing hand an IV in it?
Halfway from the tubing there was a clamp and that clamp had a syringe in it.
The plunger was depressed. I don’t remember if there was a small amount of liquid in the syringe.

Q: Was the plunger completely depressed?

Fleak: I don’t remember exactly where it was.

Q: Was there residue?

Fleak: I don’t remember?

Q: Was there more tubing below that IV port?

Fleak: Yes.

Q: Did that tubing have liquid in it?

Fleak: I don’t remember.

  • E. Fleak's report, that is a part of the A/R, clearly states that there was a yellow tinted fluid at the Y connector (IV Port)

Q: Did the tubing above it have liquid in it?

Fleak: Yes.

Q: Was that clear?

Fleak: Yes

Q: Was the IV bag clear?

Fleak: Yes.

Q: Did it have a milky appearance to it?

Fleak: It was clear

So how come she remembers this part but not the part where the propofol would have been introduced into the IV system by Dr. Murray?

[ed. Note: this is setting up the “Jackson self-injected” theory. Defense attorney was asking for location of ports, or openings, in the IV tubing, and the location of those ports, theorizing a port was close enough for Jackson to use and then clear the tubing above with saline.]

So we have 2 syringes, one is in 2 pieces under the bed the other is sticking out of the IV's Y connector port (where drugs are introduced into an IV system). Why would the defense ask the FBI to fingerprint the syringe found on the floor and not the syringe that was found sticking out of the IV port in the IV system? Why weren't both syringes fingerprinted? Why is this syringe still in the IV port? Isn't it just as likely that the syringe still in the IV port is the one that would have injected the propofol that caused MJ's death? Traces of propofol were found in both syringes so why aren't the fingerprints from both syringes being obtained?

Once again we have reference to OJ Simpson's trial. It has been theorized that OJ's mentally unstable son, Jason, was the actual killer of Brown and Goldman and that OJ was protecting him. It is highly doubtful that any fingerprint information will be released prior to the trial as the preliminary trial has ended and the actual trial has begun with the jury selection process.

The items were not found by the defense team they have always been a part of the reports and there are No clothes as the A/R reports that MJ was nude.

We don't know if the money story is true at all because this is another article from "News of The World". The family and children are on the "potential" witness list; no witnesses have been confirmed.

Bodyguards didn't hand over the footage, the LAPD downloaded it from the security system.

Lost videotapes could clear MJ’s doc

April 3rd, 2011
...the Los Angeles Police Department has admitted detectives downloaded only 11 minutes from June 25, 2009, the day Jackson suffered a fatal overdose of hospital-strength anaesthetic Propofol. But the brief sequence the LAPD handed over shows only Jackson himself returning to the mansion in LA’s Holmby Hills from rehearsals for his planned ‘This Is It’ swansong concerts at around 12.30am.

They were “astonished” to be told that detectives only kept a further seven minutes. “The defence is anxious to know exactly who came and went from the property on that fateful day and that is now impossible,” a source close to the case said. “Their case rests on the possibility that either Jackson or someone else administered Propofol over and above the dose Murray gave to Jackson himself. “Examining the full tapes was key to the third party theory. But those tapes no longer exist. Were they wiped or lost in error?” the source added.

The Fifth Amendment
A defendant is not required to take the stand in court. Moreover, the prosecution may not even allude to a defendant's failure to take the stand. To prevent the use of trials as 'fact-finding' expeditions by the government, the double jeopardy clause ensures that if the prosecution fails to produce sufficient evidence and the jury returns a verdict of not guilty or acquittal, the defendant walks away freely and cannot be retried, even if damning evidence is later discovered.

Who else has faced a battle to clear his name after being found NOT GUILTY in a court of law?
